Heard various aviation podcasters talking about this video and had to find it for myself.

Fly-by on Oakland Airport Control Tower

I don't understand how the pilot avoided a certificate action.  Even if a waiver was in place for a Red Bull event, would it have included aerobatic activity in such close proximity to a fully staffed tower?

You know, that is a very good question Ron. I'm not really up on what an aerobatic waiver will, or won't, allow a pilot to do.

I'm guessing that since the RBAR is probably being held some distance away, the people in the tower would be the only ones who could rat him out and I would have to guess that he had gotten some sort of permission from controllers to proceed (not a "Negative Ghost Rider, pattern is full"). If nothing else, it would minimize they would turn him in.
